SemoMLS.com is a website offering public viewing of real estate listings and provides data to, for and from real estate professionals and to the public. Only real estate professionals may participate as a member of SemoMLS.com to access listing data of sold properties. For sale properties will be viewable to the public. All advertisers on Semomls.com must be approved by owner with input from the SemoMLS.com advisory committee member(s).
Membership in SemoMLS.com includes benefits and responsibilities including accurate inputting of data in a timely fashion. SemoMLS.com members will be required to put 100% of their property listings on SemoMLS.com within 2 business days of a new listing or within 30 days of joining the MLS with the only exception being client refusal, which must be documented in writing by the listing agency. Open listings may not be included on SemoMLS.com.
When entering listings, all applicable information should be included and correct and all data and photos should be entered at the same time. Any changes to property listings, including properties that are sold, must be entered/;edited within 2 business days. Sold listings require additional, appropriate information to be completed correctly in a timely manner. Agent listing data will be included at input to the database but will only be seen by other members via the agent details page. No personal listing agent or agency data, name or cell phone etc will be in the description or available to the public on semomls.com or included in any photos of listings. Semomls.com is designed to market correct information about the listing first and will show the agency contact information of each listing to the public and to the other members in a standardized web format. All data inputted on SemoMLS.com is the property of owner and can be used to market listings via social media and marketing plans agreed upon by advisory board. All members can display for sale SemoMLS listings in full or in part on their personal websites but cannot refeed data to any third party. SemoMLS will not feed data to third parties for remarketing or rebranding but can feed listings to members for display on their personal websites. Feeds will not be generated to current non member owned sites. (ie, Zillow, Trulia, Home etc). Members may opt-out of sending their listings to SemoMLS.com feeds at the time of sign up. If a member chooses to opt back in at anytime a $500 fee for labor and programming will be incurred by the opting in member. Members cannot select who receives feeds and opting out would prevent a member from displaying all listings on their site. A link to SemoMLS.com from any member is encouraged. Opt-in members using feeds can only display to the public those areas that SemoMLS has approved for public viewing.
Property SOLDS shall remain on SemoMLS.com for at least 72 months or at the discretion of Creative Design Group management. Members will be asked to delete SOLDS older than 72 months at an appropriate schedule. When entering for sale or sold information, include all fields and offer complete and accurate data for each listing. SemoMLS.com SOLDS will not be open to the public.
When a listing expires, the property must be removed from SemoMLS.com immediately.
Member user names and passwords are not to be disclosed to any outsider. Any violation will result in a $250.00 fine per incident being levied by Creative Design Group and expulsion as a member of SemoMLS.com. Any distribution of user ids and passwords or any verbal, printed, stored, data or electronic conveyance of this information to any non-paying party/subscriber/member of SemoMLS.com is prohibited and will cause expelling of offending member(s) and fines of up to $250 per incident.
Creative Design Group will have the right to fine any member $100 per property for failure to list property. Failures to change property status and sales within the designated time frames will also result in a $100 per property fine. There will also be a fine of $500 and expulsion from SemoMLS.com for falsified information. In addition, failure to edit or correct data when notified can result in a fine of $50 per day per listing.
Failure to pay dues or fees within 30 days of billing will result in a 1.5% late fee per month. Any member hitting 60+ days past due will be removed as a member and be blocked from access.
Membership of SemoMLS.com should denote competency, fairness, and high integrity resulting from adherence to a lofty ideal of moral conduct in business relations. NO inducement of profit and no instruction from clients can ever justify departure from this business plan.
Members should continuously strive to remain informed on issues affecting real estate and, as knowledgeable professionals, members should willingly share this information with others. Members should take steps to identify and eliminate practices which may damage the public or which might discredit or bring dishonor to the real estate profession. Members of SemoMLS and the public having direct personal knowledge of conduct that may violate the Code of Ethics involving misappropriation of client or customer funds or property, willful discrimination, or fraud resulting in substantial economic harm, are asked to bring such matters to the attention of Creative Design Group or another Member of SemoMLS.com.
SemoMLS.com members shall maintain a regularly established place of business, which shall be open to the public during usual business hours or at regular stated intervals. This place of business shall have a business sign of sufficient size to identify it and bearing name under which the firm is licensed, or the regular business name, and shall be displayed outside the regular place of business.
Cooperation with other real estate professionals promotes the best interest of those who utilize their services. Members of SemoMLS are urged to adopt exclusive representation of clients; not to attempt to gain any unfair advantage over their competitors, and refrain from making unsolicited comments about other practitioners. Members should conduct their business so they minimize controversies and avoid conduct that demeans the Membership or is contrary to good agency practice. In all dealings, Members must treat each other in a professional manner that does not disadvantage negotiations.
